Background Checks and Firearms

So Joe pointed out today that the new battleground for firearms rights is going to be background checks.  Our opponents are realizing they lost the fight to ban the right to firearms.  His quote points out where much of the future fight is going to be.

Joe points out that background checks are teetering on the edge of registration.  If the FBI runs a NICS check on someone you can be sure they are in the process of buying a firearm.  If they maintain that record they know every individual who purchased a firearm and had a background check.  Currently all this would take is to stop the record deletion after 24 hours.  That’s it, just stop the delete call in their system.

My personal experience has transformed me from someone who would possibly ignore the inconvenience to someone who understands it’s pointlessness, how it allows for the violation of rights, and why it does nothing for the benefit for the security of society. 

For those who are unaware I was charged with 2 felonies, both non-violent, in 2005.  The charges were brought about because of a very bad auto accident.  Both of these charges were dropped and I have never been convicted of a felony.  There is no legal reason, or even social reason  why my right to a firearm should be restricted.  I have never done anything provocatively violent, I have never presented a reason that I am a threat or danger to society.  All that happened was I had a bad accident in poor weather and road conditions.

Now with that history in mind, whenever I go to purchase a firearm the NICS check issues a hold on the transaction.  I am not allowed to pick up the firearm for 5 days until they finish their “background” check.  I had my concealed weapon returned to me by Washington State Patrol after the trial, with a notarized letter from the prosecutor stating there is no reason to restrict my rights to a firearm, and yet I was given a full Deny while trying to purchase a weapon.  It took a full year before that issue was fixed.  I tested it once a month with a friend who has an FFL in Moscow.

It has been said, “A right delayed is a right denied.”

In the case of the year of 2006 however I had every right to a firearm yet I was denied.  Even today I am delayed in exercising my right to purchase a firearm.  I can file with the ATF and FBI to retain my NICS record so the hold will no longer occur.  For those that miss that translation, I waive my right to have them delete the record and enter the realm of having registered myself with them.

There are many who would claim that background checks are a wonderful thing.  Helping to stop domestic abusers from getting firearms and elevating their crimes.  Except it will also prevent a battered woman for seeking a tool that will level the playing field.  The blade cuts both ways and I care more about the cuts towards the innocent and law abiding.  If someone is considered to be such a threat to a person or society that they can not be trusted with a weapon they should be placed in prison.  The Lautenberg Amendment, while well intentioned, violates due process and allows for the confiscation and deprivation of rights of an individual without their facing their accuser. 

There are numerous other tools that can be obtained, without background checks, that are just as dangerous and deadly in the hands of an abusive spouse.  You can’t perform a background check on someone before they’re born.  Doing a background check does nothing to stop someone without a history.  Not only that, there are ways to avoid having a background check when buying a firearm.  Even if you make private firearm transactions illegal, it will still not stop the black market and back alley firearms sales.

I’m all for stopping abusive people from getting their hands on weapons.  My problem is anything can be a weapon and when the “solution” to the problem delays the innocent that the law is trying to protect.  Background checks are nothing but another tool to be used to infringe on a constitutionally guaranteed right, as stated by the SCOTUS in Heller and McDonaldNot that the constitution really matters in this fact anyway.

Starbucks Appreciation Day take 2

Sebastian, today, called for another Starbucks Appreciation Day.  I have created a public event on Facebook to help get the word out.  Feel free to join and invite more people.

Thank Starbucks for following local laws and not discriminating against citizens exercising a constitutional right.

The National Gun Victim's Action Council, an anti-rights group, is planning a boycott of Starbucks because the company does not discriminate against gun owners and those who exercise their right to carry a firearm for self defense. Starbucks respects local laws and does not create their own rules to disarm law abiding citizens

The company should be thanked for their continued respect of local laws, the Constitution, and the Bill of Rights. Let Starbucks know we appreciate their stance and they should not bow to the wants of any anti-rights organizations that are truthfully in the minority.

[This is a twofer for a reason since it’s all closely related.  I did exactly what Joe says above right here for the rest of the world to see.  Some have implied I wasted my time* and that there is no point arguing with Joan.  They’re right, and as I said here there is no point arguing with Joan.  So was it a waste of time?]


No, Joan's comments didn't have any adverse effect on me, but they might have on someone that's had similar experiences to mine.  I put my experiences out there for those who have not yet gotten to a place where they can.  You didn't just cover my six; you showed them you've got theirs too.

[As I said yesterday,

If I have one actual weakness it’s that I have a nasty habit of standing up to defend my friends.  Even if that means I need to drop kick a pig that wants to roll in the mud.  If that’s a weakness though, I find it a good one to have.

Yeah, I can live with that as a weakness.

I did not waste time arguing with Joan on her own site.  I did not waste time trying to jump through her hoops for approval.  I walked out in to the middle of the street and called her out for all to see, I did it here on my own site.  I exposed her hypocrisy, attitudes, and her actions that prove how horrible her and her position is.  I did it where the comments were open for anyone to participate.  While doing so I was also stepping up and  to help some friends.  It helped one more than I realized it would at the time I wrote it.

I often say I do this for me.  Well I do, if I don’t give out free ice cream well so what.  I don’t get paid, I pay hosting fees out of pocket, so why would I waste my time arguing with the likes of Joan Peterson?  I wouldn’t and never have.  What I have done is step up to tell my friends I have their back and help expose to the world the evil that she is. 

Honestly I don’t know if anyone like Jennifer talks about has been or will be helped by my post.  I have to to yield to Jennifer’s experience which is far beyond my own in this realm.  I would like to think it would and I can certainly see how.  Ultimately though Jennifer’s point is irrelevant.  It’s irrelevant because it did help a friend, and it helped her through the healing process of her own story.

Waste of time?  I think not, it was absolutely worth every second spent. –B]

A Vigil for the Victims of Violence

The Brady Campaign announced an effort to hold a candle light vigil in honor of the victims of “gun violence” today.  Weer’d came up with the idea of holding a vigil for all victims of violence.  Weer’d suggested we do this by having us post pictures of a candle with our defensive arms.

First up is a friends S&W 5906.  He didn’t have a good camera and lives down the street so he came over tonight and we just did all the arms at once.

A candle does nothing to stop violence.  It does nothing to protect this mans family from harm.  This pistol however provides him, as well as his wife, an effective means to fight off a stronger attacker.  This provides them an effective means to ensure the safety of their children.

I followed that up with my standard open carry arm.  A 5 inch Kimber Custom Classic.

An Afternoon Pick Me Up

Initially I wasn't sure I was going to do a post on this since Bitter already touched on it.  Then the wife emailed it to me and I watched this video and busted out laughing at the end.  If this is in your RSS, for some reason Google Reader won't embed the video.

You're killing me smalls!  Let me get this straight, you helped your buddy break into the house of the girl he was stalking, he got shot, and you called 911!?  If there's a dumb criminal of the year award, he's definitely a finalist.

Serious props to the young lady for defending herself and her child.  I supposed that Joan Peterson would have preferred that she wait to shoot until the intent was perfectly known and the woman's body going to room temperature instead of the assailant.  Maybe it was just a normal armed robber? 

The bottom line is this is why I carry, even at home.  When I get dressed in the morning, that includes putting on my firearm.  Bad people exist in the world and they don't call ahead when they plan on doing bad things.  If you don't want to listen to me telling you to leave with my mouth, individually dispensing 230 Grain packages of hot lead will convince you leaving is the better option.  The bad news is at that point you're going to be leaving the corporeal world.

On Dancing In Blood

While I was busy this weekend I heard about a shooting in Mount Rainier National Park.  I didn’t have time to investigate, though this morning I heard details about it on the radio.  I figured the blood dancers would be out, I just didn’t think how idiotic they would be.

Miguel this morning just how dumb and crazy they were.  They wasted no time to blame the shooting on the NRA and the modification of the National Parks rules which said they had to follow state law regarding weapons and concealed carry.

There’s some serious problems with this logic though.

First and foremost is that the individual was a prohibited person under the Lautenberg Amendment.

In July, the mother of Barnes' young daughter said in court papers seeking a protection order that he "has possible PTSD (post-traumatic stress disorder) issues," NBC station KING of Seattle reported. In seeking sole custody of the girl, she said Barnes was suicidal and "gets easily irritated, angry, depressed and frustrated." 

Second the park shooting was not the first shooting that day.

Witnesses told investigators that about nine people attended the party, many of them armed, and some had a "show and tell" with their guns. Some fired shots in the air to celebrate the new year. At 3 a.m. Sunday, one partygoer asked to see another's gun and then refused to give it back.


At least two people drew their weapons — Barnes was one of them — and four people were injured in the shootout, two of them critically, the sheriff's office said Tuesday. It wasn't clear who fired first.

So this individual illegally had a firearm, engaged in a shoot out with other individuals, then fled.  Yet somehow he was going to magically be stopped at an invisible border and turn around because you’re not allowed to carry a gun!?  I’ve driven through Mount Rainier national park numerous times since my 21st birthday, I often had a loaded firearm with me.  Why?  Because unnecessary handling of a firearm is how accidental discharges happen.  I was usually driving through on my way home to visit friends and family while on break.  Did I shoot anyone? No, it stayed in it’s holster the whole time, where it’s safer for everyone.  Yet these blood dancing savages criminalized that behavior and insist that it is horrible for public safety.  The would prefer I unholster at each side of the park and unload and reload.  Each of those instances provide for the chance of a accidental discharge.

You know what is really horrible for public safety.  Running out and dancing in the blood of the innocent blaming tools and inanimate objects.  The sole goal in doing so is to disarm the law abiding to ensure their victim status.  They focus on attacking the right of self-defense instead of trying to actually get people the help they need.  Why would you need to carry a firearm for self defense in a national park they’d ask.

The visitor center was locked down, with tourists finally being escorted out by armed guards after midnight. To warn one group of backcountry campers of the situation, authorities flew over by helicopter and dropped handwritten messages on paper coffee cups that a gunman was on the loose, according to postings and photographs on the nwhikers.net message board.

Looks like that question is self answering in this incident.  Tell me, were the authorities going to be able to protect those hikers in the back country of the national park?

Overall I find the behavior of the Brady Campaign and CSGV down right despicable.  Instead of trying to get people the help the need, which would help prevent incidents like this from ever happening, they insist of disarming the public and attacking inanimate objects.  They insist on ignoring the individual.  The individual is always responsible for their actions.  That said, if you want to help prevent things like this from happening, you should be seeking help for them if you are in fear for your safety.  Instead of actually trying to find out what was wrong, just like Jared Loughner, people ignored the signs.  The innocent shouldn't be punished for the choices of others.  The correct way to help with this problem is to make sure to help those who are disturbed before they break.  Treat the individual in trouble, don't disarm the victims.

Guns, Not Just for 2 Legged Varmints

This is why you carry your guns, even if you're not worried about varmints of the 2 legged variety.

The Sierra Vista Police Department, assisting the Cochise County Sheriff’s Office, and a witness to the incident confirm that the woman was walking her dog in the area of Risner Boulevard and East Central Avenue when she was attacked by no fewer than three dogs.

This has a better ending than it could have otherwise.  People were there attempting to help, but it took someone arriving with a firearm before the attack was stopped.

Gathered around the woman and her dog were several people attempting to fight off a brown boxer and white pit bull, as well as another unidentified brown dog, he said.

“There were like eight people there trying to get these dogs off her,” he said. “By the time I got there, (the dogs) were focused on the victim’s dog, which looked like a heeler.”

Corcoran said he aimed his 45-caliber handgun at the brown dog and fired, hitting the dog, which ran off along with another dog

It took a firearm to actually stop the attack.  As Tam said , "If you don't have your own pistol, you may have to wait the rest of your life for the police to bring theirs."  Thankfully for this woman she didn't have to wait for the police, she just had to wait for a neighbor down the street.  So please, carry your guns people, you could just as easily save the life of someone else as well as your own.  And that predatory varmint may be of the 4 legged variety, not always the 2 legged type.

A Girl and Her Gun - Someone Doesn't Like Me


[Seriously go read the whole thing.  What has the anti rights crowed ever offered a woman in the same position?  What does the Brady Bunch, CSGV, and the rest of them offer this woman to allow her to gain her life back.

Gunnies reach out and help, many of us have seen that terror ourselves first hand or in the eyes of someone we know and care for.  Even if we haven't, we have the empathy when we see it to know it could just as easily be someone we know.  We thrive off of empowering people to be the masters of their own destiny.  Empowering them to say no with with such conviction as to preserve their own lives as well that of any possible future victim.

Find me a single instance where any of the gun grabbers have produced a result like the above.  The anti rights cultists aren't for stopping violence, they thrive on it.  It's how they peddle their lies and push their legislation that would serve to disarm us and prevent us from living free but in fear.  Their goals are to destroy the freedom and comfort that people like A Girl and Her Gun have found after being an actual victim of violence.  

As I said in her comments, stories such as this fill me with joy.  While I'm sad for her trauma, I'm glad that our community, as it so often does, provided her safety and comfort while training her how to live free after discovering a wolf in the pack. -B]

Ian Harrison - Top Shot Winner Becomes U.S. Citizen


[I don't watch Top Shot.  Not for the fact I dislike the idea, I love the idea and how it normalizes the shooting sports.  I don't watch it because I don't watch a lot of TV and of the TV I do watch I could care less about the drama llama that is reality TV.  I do however absolutely love what can be observed from the quote above.

This man was forcibly disarmed by the country he defended and decided that country no longer deserved his citizenship.  That is the power of gun control.  It causes people to flee, yet you don't see American's fleeing to Great Britain due to their low crime rates and gun control.

Welcome Mr. Harrison to you and your wife.  You obviously are in the right circles and find yourself in good company here.  -B]
