SSCC #145 - ICE

Apparently ICE just couldn't keep itself out of the count. So today is going to be a double on the SSCC.

On the night of October 20, 2010, Angel Enrique and Jesus Antonio were in bed in their small, two-bedroom apartment in the Clairmont complex in Nashville. The doors and windows were all shut and locked. Suddenly there was a loud banging at the door and voices shouting "Police!" and "Policia!" When no one answered, the agents tried to force the door open. Scared, Jesus hid in a closet. Immigration and Customs Enforcement (ICE) agents began hitting objects against the bedroom windows, trying to break in. Without a search warrant and without consent, the ICE agents eventually knocked in the front door and shattered a window, shouting racial slurs and storming into the bedrooms, holding guns to their heads. When asked if they had a warrant, one agent reportedly said, "We don't need a warrant, we're ICE," and, gesturing to his genitals, "the warrant is coming out of my balls."

Here's what bugs me the most. There were 15 different residents affected by this raid, they detained people including a child purely because of their ethnicity.  This incident shows exactly what the Department of Homeland Security thinks of the Constitution and the law.  Just look at the VIPR program and the fact the TSA is now searching people traveling by bus as well as harassing truckers.  How long until they start stopping you on the way to work?  I would like to point out the double standard of the ALCU here.  They are more than happy to go after ICE over these incidents involving immigration, yet they sit on their hands when it comes to warrant-less searches during travel.

Tam's comments regarding the indignities of Soviet Russia from the 80's is looking like a positive compared to the down hill trend the DHS has placed us on.

[I have mixed feelings about the killing of Anwar al-Awlaki.  On the one hand he technically is an enemy combatant.  On the other he's a US citizen and the decision for his death shouldn't exactly occur behind closed doors.  It is a slippery slope that many are willing to look past because we all know he was such a bad guy.  Letting things like this slide establishes a precedent that could be very bad.  Especially with how easily and quickly the government is labeling different groups of individuals as potential terrorists.  Roberta nails it on the head, eventually you're going to be the cockroach.  -B]

SSCC #118 - Atlanta Metro

Hoolihan's was just one of 12 disturbing complaints filed against Hobbs over the last five years at the Clayton County Police Department. 

At that rate he must have been going for Officer Roid Rage's record.  That's 2 and a half complaints a year and no one thought that maybe this was a clue?

Excessive force is the norm for this guy and he is more than willing to hide behind the law.  The internal affairs department is the watchers watching themselves.  Don't think that's really the case?

CBS Atlanta confirmed there has been no disciplinary action taken against Hobbs, and not a single day of suspension for an officer with 58 incidents of use of force. That's nearly 20 times more often than an average Clayton County police officer had in the same time period.

Evidence Your Budget Should Be Cut

When you have the excess man power, facilities, and equipment to do the following.  Your budget is too big.

In a city that hosts its fair share of murders and terror plots, Washington, D.C., police are cracking down on another threat to the nation's capital -- expired vehicle registrations. 

To the frustration of forgetful drivers, Metropolitan Police Department officers are throwing people in jail for letting their tag renewals lapse. The practice provoked somewhat of a backlash last year after a local mother from Maryland was jailed for what in many places would be a routine traffic offense punishable by fine. But the department continues to reserve and exercise the right to throw drivers in the clink for missing the DMV deadline, no matter where they're from. 

Sending people to jail for expired tags is necessary because of what reason?  A fine is reasonable, but what benefit does jail time serve?  It is often touted how over taxed the jail and prison systems are.  Well it's no freaking wonder if they're tossing anyone and everyone under the sun into jail.

Here's a new set of rules:

  • If you have the excess man power for something like this
  • If you have the excess jail space for something like this
  • If you can continue to perform all your other functions as well

If you match those conditions, your budget should be shrunk.  By how much, enough that the first two are completely unsatisfied, and your officers are doing free overtime to keep up on bullet 3.

On the Puppy Killing Swat Teams - SSCC #116 & #117

Apparently beat cops now joining their jack booted brethren in shooting dogs anytime they get the chance.

That dog was not a threat, it was not aggressive, it was on a leash pole to boot. Do you expect any animal to be happy about being captured like that? What the hell is wrong Lagrange Police department?  Is this standard operating procedure to catch a dog and then execute it?

In the words of Jack Swager, "I don't think you understand, they killed my dog." 

Jay's rage meter doesn't even go high enough to display my level of pissed off.  There is no doubt these men are still on the force.  After all it was just a dog right.  No matter that one of the characteristics of a budding serial killer is someone who tortures and kills animals, especially those placed in a defenseless state.  I see no reason to have shot that animal, it just wanted to be left alone.  If anything that police officer was the aggressive animal in that situation and should have been shot*.

Because why should the swat team be the only ones to get to kill puppies?  Especially since the beat cops catch them first before shooting them.

*I don't normally wish harm amongst other people, but I wouldn't shed a tear if either of these asshats house burned down with them in it.  Seriously, I find value in human life, and I find it despicable when the anti-rights folks wish harm upon others.  This situation though I think is an exception to my rule.

SSCC #114–Manchester PD

The statements from the police department and the school say’s it all.

This is by no means the first time for an incident like this, but at least this kid was lucky enough to live.  This was your normal sibling harassment.  My sister and I used to pick on each other all the time like this.  The school officials injected themselves into the situation unnecessarily, including searching his sisters property without consent.  The officer then proceeded to use force after the student asked why he was being suspended.

This is what happens when you put bored police officers in positions of power.  Not to mention the fact that many school administrators claim, wrongfully, that students are exempt from the Bill of Rights, as well as other basic rights.  No they are not, not to mention the fact that those rights are inalienable, and no lien can be placed upon them because of age, gender, sex, creed, or any other reason.  Those rights are non-negotiable and you have violated them.  It was obvious that the school was nervous about the situation, as well they should be, by the fact that they were attempting to destroy and suppress the evidence.

None of my teachers were ever dumb enough to lay a hand on me, ever.  These teachers attempted to unlawfully restrain a student while documenting a interaction with a public official in a public building.  News flash to all involved, those teachers are public employees as well.  While at work I do not think they have a right to privacy when it comes to their employment.  If a student wants to document something they find questionable they have every right to.

This whole incident is just another example of how the educational system is deluding students into sacrificing their rights and providing a method for Officer Roid Rage to get his rocks off.

SSCC #105-110, Detroit PD

A former suburban Detroit police chief, his wife and five police officers have been charged with stealing drug-forfeiture money and using it to buy marijuana, booze, prostitutes and a tanning salon, The Detroit Free Press reports.

Basically the chief and his officers used material confiscated from others to fund their own personal lives.  It didn’t belong to the state, it belonged to them because they were the one’s who took it.  Besides if we doctor the sheets here and there no one would ever find out right?

Seriously forfeiture laws do nothing but provide extra leeway for the corruption of government.  A friend brings drugs over to your house without you knowing and sells to someone else?  Congrats the feds can now confiscate your house.  It’s one thing to require illegal material to be forfeited, legal property is something completely different.  While it might make since to recover stolen property or funds, again the state isn’t maintaining ownership there after.

SSCC #103/104 - Miami-Dade Police

This young man had done nothing wrong.  These officer were out looking for a good time, nothing more.  Not to mention the fact that he quite obviously through his appearance and speech has down syndrome.  He was the perfect victim for these bored officers to abuse.

A bulge could be any of a number of things that do not include a weapon.  I can think of many which are health related.  I have a friend who has a bulge due to an insulin pump.  My dad had a bulge from his pain meds just before he passed away.  This doesn’t even include the idea that maybe clothes got bunched up, or they are concealing something they would just rather not have seen.

The idea that concealing something automatically provides a reason for law-enforcement to stop, detain, and search you is disconcerting on so many levels it’s not even funny.  Especially since a search is not legal unless you are being placed under arrest.

Looking at this from another point of view, what if that had been a legal concealed carrier?  That person could have been easily ventilated on the sidewalk by what appears to be Officer Roid-Rages yet another of cousins.

SSCC #100–Las Vegas PD

I was wondering what to use for #100.  There were a few incidents I could think of historically that I had already covered that fit rolling over to 3 digits.

Erik turned to find three officers facing him, guns drawn, and all three shouting different commands: “Get on the ground!” “Drop your weapon!” “Keep your hands up!” Erik held his hands up, spoke calmly, told them he DID have a concealed firearm and a legal CCW and was an ex-Army officer. His girlfriend was screaming about Erik being a West Point grad, former Army officer, etc. Erik leaned to his left, hands still up, to expose the pistol, and repeated, “I am disarming; I am disarming.” Witnesses say he started to lower his right hand, palm OUT, perhaps intending to remove holster and gun together — but never got the hand below his shoulder, when one of the cops (believed to be William Mosher, who had committed a fatal shooting in 2006) shot Erik in the chest with a .45-caliber semi-automatic weapon. Erik dropped to his knees, clearly in shock, his face a picture of disbelief. He was shot a second time and collapsed. The rest is ugly. The three officers unloaded again, firing a total of seven hollow-point rounds. At least four, possibly five, hit Erik in the back, after he was on the ground and dying.

It ends up that Erik’s firearm never left it’s holster.  The call from Costco evidently also primed the pump for the officers to “see some action”.  The entire incident was a gigantic Charlie Foxtrot from the very beginning.  No single officer was in command, everyone was.  No effort was done to be civil or just find out what was going on.

Their solution to the problem was determined by them before they even got there.  We’ve seen that type of behavior before and it never ends well.

During the investigation some of the testimony was quite disturbing.  From the testimony it sounds like the Pima County Sherriff took lessons for the Gurerena raid.  Officers started shooting and didn’t know exactly why.  They felt justified because their fellow officers were shooting so their must be danger.

Self-restraint is a very important personality trait.  Even more important when your actions and behavior can cause a chain of events that will result in the death of an innocent.

SSCC #98 –Atlanta PD

A physically disabled Atlanta woman, who said she was thrown to the ground and arrested for refusing to get out of her chair, is seeking compensation.

Dan Grossman, an attorney for Shequita Walker, 40, said she was sitting April 21 on a metal chair in the vacant lot next to her home, where she often sits on hot afternoons, when police officer Kenneth Thomas approached and asked her to move, The Atlanta Journal-Constitution reported Friday.

Grossman said Walker, who suffers from severe joint pain and has a limited range of motion, told the officer she was within her rights to sit outside and Thomas then twisted her arm, causing her to fall to the concrete.

This is what happens when cops get bored.  It’s quite similar to this incident in which the judge joined in on the party.  The wife just forwarded me a nice article with a picture taken during the arrest.

Seriously on what planet is behavior like this deemed acceptable?

Because when you’re bored and someone’s sitting on a public bench.  Ask them to leave for no reason or justification.  One way or another you’ll get to use force.
