SSCC #499 – Idaho County

An Idaho County sheriff’s deputy has pleaded guilty to felony sexual battery for a sexual relationship he had with a 16-year-old girl last summer. The Lewiston Tribune reports  31-year-old Daniel L. Funderberg of Kamiah pleaded guilty Thursday during a hearing before 2nd District Judge John Stegner. Lewis County

He was placed on administrative leave after the charges were filed and is looking at a three to six-year suspended sentence under the recommendation of the prosecutor.  Nice huh?

SSCC Honorable Mention – Murray County

According to court documents, on October 8, 2011, Billings, while working in his capacity as a deputy sheriff, physically assaulted the victim, who was handcuffed at the time and not a physical threat to anyone. Billings tackled the victim to the ground, positioned himself over the victim, grabbed the victim by the chin, and began to bang the victim’s head into the floor. In so doing, Billings subjected the victim to unreasonable force, punishing him for verbally offending Billings. As a result, the victim sustained a mild concussion and suffered pain and swelling to his head. Billings knew that he was prohibited from using physical force on a restrained arrestee who is not a physical threat and assaulted the victim anyway.

I should probably be counting this, however he is facing up to 10 yeas in prison.  What does disturbs me is that no one stepped up to defend the victim.  The whole thing is down right despicable and I will try to watch for updates on sentencing.  If the judge is lenient this one’s going on the count.

This one is presented entirely without further comment.

The Metropolitan Police Department officer accused of sexually abusing a young girl in the youth choir he directed would send the rest of the group to the store and order his victim to stay behind, according to court documents.

During rehearsals, the court documents say, Palmer would tell the girl to stay with him in the pastor’s office while the rest of the choir members went to a store.

Of note:

Palmer, who joined the police force in 1990, got into trouble in 2004 after a woman flagged him down while on patrol to tell him about a domestic dispute. City records show that Palmer allowed her into his marked cruiser, took her to a restaurant and brought her back to her apartment.

The woman’s husband and aunt came home and found them, according to the records. They filed a complaint with police, who suspended him for 35 days for conduct unbecoming an officer, failure to obey orders and neglect of duty. In 2009, the D.C. Office of Employee Appeals reduced the suspension to 13, awarding Palmer back pay

SSCC #496 – San Antonio

A San Antonio police officer who is accused of extortion — and was watched by a surveillance team as he reportedly picked up the cash while on duty in his patrol car — was charged in federal court Friday morning.

Now at first glance that doesn’t sound too bad does it…

After he admitted having a small amount of marijuana in his car, the man said Lundy detained him and told him he could “help him out,” by not filing possession charges if he got $400 in return, according to the affidavit.

The man told Lundy he didn’t have the money on him but that he could provide it by Jan. 2. He was allowed to leave and subsequently received phone calls from a blocked number concerning the payment, which had gone up to $500, the affidavit said.

But remember this drug was is for our safety and the betterment of our communities.  No word on the termination of his employment yet.

A corporal with the Bexar County Sheriff’s Office already on administrative leave for allegedly kicking out the windows of an arresting officer’s patrol car has returned to jail — this time for an alleged drunken driving wreck in which police said they twice had to stun her with a Taser.

Susana Lisa Cervantes, 35, who has been a detention officer since March 2008, was booked Thursday night for driving while intoxicated, assault of a public servant causing bodily injury and retaliation.

With that in mind, it begs the question, “What does it take to get fired in Bexar county?”  Currently she is on unpaid leave and has been since September 28th for an arrest on criminal mischief.

SSCC #494 – Whitaker

A suspended Whitaker police officer will stand trial in January on charges that he used his gun to break a driver’s window during a traffic stop and threatened charges unless she paid to fix his damaged gun.

William S. Davis, 35, is charged with official oppression, making a false statement, criminal mischief and a criminal attempt related to a threat in connection with a June 27 traffic stop.

This one makes the count for the following line:

Whitaker police Chief John Vargo, who testified in Officer Davis’ defense, said he consulted with Officer Davis by phone that day in June and told him it would not be illegal to make that deal but that the decision was up to him.

Uh, that’s not how it works sparky.  What we have is an officer with an obvious temper problem and an abuse of power problem and you just wrote him a ticket to intimidate and harass people unlawfully.  She was smart contacting an attorney because that behavior is unacceptable.

Go read the story, is the classic list of excuses, such as:

Officer Davis also told authorities he had been looking for a sedan involved in drug activity that resembled her vehicle.

The victim in this case drove way because she was fearful since the officer was NOT in uniform and driving an unmarked car.  Pro-tip for idiot cops, next time call a black and white to make the stop.  Most reasonable people wouldn’t trust that situation.  Pro-tip for the victim, promptly call your local dispatch and inform them that a vehicle is attempting to pull you over and the officer doesn’t appear to be in uniform.  This helps your credibility.  If you have no phone, drive to the closest police station.

[First, let me be perfectly clear.  μολὼν λαβέ or molon labe Representative Muhlbauer.  I didn’t go shoot anyone with my firearms and neither did the majority of gun owning Americans so leave my property alone.

If you desperately want my property, I request that you lead the confiscation teams so that those you would attempt to use force of government to steal from can more easily deal with the tyrannical bureaucrat who sent the jack booted thugs to their door.  However like most petty tyrants you won’t actually bleed for your cause, instead you will send others to do your dirty work for you.

I will restate this for those who may have never seen my tripwire post, more specifically the lessons of the 20th century:

Lesson No. 2: If a bureaucrat, or a soldier sent by a bureaucrat, comes to knock down your door and confiscate your firearms– kill him. The disarmament of law-abiding citizens is the required precursor to genocide.

A word of warning though Mr. Muhlbauer, if any of those you attempt to kill succeed in surviving and escape, my assumption is they are coming for YOU.  A man like that will be on the run already and ultimately have nothing left to lose.  In the process of attempting to steal his property, you threatened his family, invaded his house, and even attempted to kill him.  Think about that sir, you may not be pulling the trigger yourself, but you’re creating the laws to tell others to kill people for you.  You are responsible!

I didn’t put a gun in anyone’s hand, I didn’t pull the trigger, I had absolutely nothing to do with a mentally deranged individual, yet you want to hold me and others like me responsible.  You would disarm us to leave us as defenseless as those children, praying that the police show up in time.  Tell me, did the police show up in time?  Because it took 20 minutes and it was a blood bath that any responsible gun owner could have stopped if they were there, but you sir would disarm them.  You would take their property or imprison or kill them.

That sir is sick and down right despicable.  You claim to be about protecting the children, yet you would have masked men invade homes in the middle of the night heavily armed killing anyone inside who merely looked like they might resist.  Think I’m exaggerating?  Look at your war on drugs and the number of innocent people killed in the wake of that mess.  You would use the force of government to kill otherwise law-abiding citizens for the victim-less crime of merely owning property.

Who is the mass murderer here Mr. Muhlbauer?  Who is attempting to use force to coerce others into behavior you, Mr. Muhlbauer, deem acceptable?

One group wants to merely be left alone, another group blames the first for tragedies the first group had no part in.  Tread wisely Mr. Muhlbauer.  We are not bloodthirsty and we aren’t out to kill or hurt people like you would claim.  We will however defend ourselves and our natural rights, rights that you have no say in.

To the people of Iowa, find a way to run that tyrant out of his job.  Sadly your state doesn’t support recalls like mine does, and yes I’m already looking into what needs to be done to recall a politician.  Anyone who votes yes from the State of Washington for an Assault Weapons Ban or Magazine ban, I will lead the charge to remove from office.  Some officials may think their reelection would be at least 2 years away, not true in some states.

There’s the Soap Box, Ballot Box, and Cartridge Box.  An attempt to remove anyone of the three options for defending ourselves and ensuring the governed can revoke their consent results in the third box being the only option. –B]
