James Melvin Bradshaw, a narcotics officer for the Canton Police Department, was indicted by a federal grand jury on March 27 and charged with six counts of acquiring a controlled substance by misrepresentation. Bradshaw was arrested this morning and went before U.S. Magistrate Judge Judith Guthrie this afternoon for an initial appearance.

It’s such a wonderful thing we have this war on nouns right?  Look at all the good it does for society and how it allows officers to expand their horizons.  This one doubly makes the count because he took it from people who had legitimate prescriptions.  In other words he stole from law abiding citizens.

Because when you’re a narcotics officer, harass whoever you want, even if they’re lying in a hospital bed.  They don’t need those pills now do they.

Of course, you’ve got to pay your attorney, and because your car, guns and magazines were “seized for cause,” that is, the property was confiscated because you in fact broke a law, you will probably get your car back, but Denver and surrounding municipalities have a policy that NO guns “seized for cause” will be returned.

That’s the minor “inconvenience” that the Governor says is definitely worth inflicting on law-abiding Colorado citizens for a law that will, according to B-Ho’s own Justice Department says will have NO EFFECT WHATSOEVER on crime.

[If you want a clue at the real intent of these laws, look no further than New York and this recent discovery:

Nearly a year before signing the nation’s most stringent gun control measure into law, New York Gov. Andrew Cuomo launched a hotline that allows state residents to report illegal gun owners in exchange for a $500 reward.

Tell me, if this was really about lowering violent crime rates, why not actually offer that reward for catching people actually doing bad things?  Instead they created this broad bill that criminalizes every gun owner and are encouraging neighbors to stab each other in the back.

Here’s a tip for anyone living in that crap hole, get a 30 round mag from across the border and toss it in your local representatives car and have someone else call it in.  Even better toss it in their spouses car.  Even better if they’re a Fudd and just more than willing to throw you under the bus while they enjoy the rights they would deny you like Gabby Giffords and her husband.

There is no question in the intent of these laws, doubly so as the people supporting them also scream about confiscation. Next time someone tells you they’re not out to confiscate weapons, call bullshit.  There’s enough on the table now that anyone who says that is merely lying or not paying attention.  Frankly if you’re not paying attention, STFU, you have no business talking with regards to this conversation. –B ]

[And as Kevin points out, that’s not how it is supposed to be.  I find this a much more applicable description.

I should not be fearful that someone is calling the state because I took a picture of my child with a firearm.  I should not be afraid that the state is going to come kick down my door because someone provides some false information for the “war on drugs”.  We are living in a police state.

I have an idea for a post but I’m just not sure how to write it or string the thought out completely.  The premise though is the meaning of the law is becoming worthless.  More and more laws are being created, laws the creators admit are unenforceable.  This leaves two different options:

  • The law no longer really matters and is nothing more than an empty symbol.
  • The law now exists as a tool to manipulate, scare, and intimidate those they deem undesirable.

Tell me, what good do these new gun control laws do?  How does that actually benefit society, especially given they admit it will not make a difference and innocents will be caught in the crossfire?  The actual effects will cause people to choose between being safe or committing a felony.

But that’s their goal, scare and intimidate law-abiding people into giving up their rights.  Cause them to have to be unsafe to adhere to the asinine laws.  I’m of the opinion if the law has degenerated to the point that it is criminalizing the free exercise of a right, that it’s sole action is to criminalize the innocent, I might as well just accept the fact they want to treat me as a criminal.  If that’s the case and I’m going to be punished for owning something or doing something that doesn’t affect anyone else, maybe I should actually do something worthy of being called a criminal.  If I’m going to be given a penalty anyway, why not actually do something to earn it?*

The law is loosing its worth and these people are rejoicing at it’s destruction.  They don’t seem to understand it’s perversion is being done in such a way so the state can consume them just the same as it consumes us. –B]

*I am not saying one should currently, but certainly this does factor into the tripwire question.

Like you, I want safer families and safer communities. Like you, I think it is appalling when bad people use firearms to do bad things. And like you, I want to see lower rates of violent crime and higher rates of good people staying safe. That is why I am a strong supporter of liberal laws in the area of concealed carry, and it’s why I am in favor of laws that improve the ability of ordinary people to protect themselves wherever they go. It’s also why I support the freedom to purchase and own firearms without a lot of bureaucratic tangles. Because I want good people to be safer, I support laws that make it easy for good people to protect themselves from violent crime.

Kathy Jackson – “Reasonable” Restrictions

[Like Kathy, I don’t see anything “reasonable” about restricting a human right.  Heck, I’ve described it previously.  My care and concern is for the law-abiding.  More specifically the innocent who would be victimized. There is nothing “reasonable” about trying prevent these people from obtaining arms.

Many look at 1588 and consider it reasonable.  The more I think about that bill, the more I become very concerned and very afraid.  The burden of proof will be on the seller that he complied with the law.  It will be nothing more than a gotcha used when they want to hang you but cannot find something else.  There are some serious problems with it and on the surface it sounds like a good law.  No law-abiding person wants to just hand a firearm over to someone who is prohibited.

My problem is instead of creating a tool to help those people perform that function, they have created a method to hang that citizen should the government ever feel like doing so.

They could easily indicate on people’s drivers licenses, which are renewed every 5 years, whether someone is a prohibited person.  Do it on EVERY license.  Make this valid instead of the NICS check as well, which would be much like the Idaho CPL in Idaho.  You have now alleviated federal burden and created a tool to help every citizen in keeping guns out of the hands of prohibited people.

Now what happens if the persons status changes?  The state confiscates the old license and issues a new one.  What about those without license, Washington has state issued ID as well, not to mention most owners would become weary of those who refuse.  Could bad guys still forge a license or the endorsement?  Yeah, but it’s merely a tool to help and you’re not going to hang someone who honestly intends no harm in the process.

It’s a crime to knowingly transfer a firearm to a prohibited person.  You have given an extra tool to the citizen to verify that person isn’t prohibited   The fact it is on everyone’s license prevents a registry.  The biggest issue is those who don’t have a license or state ID, it honestly shouldn’t be required to exercise a human right.  I view this mainly as a tool to help honest people and most people can easily exercise good judgement and currently they do for the most part.  No legal requirement to check, this prevents the catch-22 of placing bureaucratic onus on the seller, but having it there most people will do the right thing.  Heck, honest buyers will pull it out just to prove they’re good to go.  No need to record anything, no need to write it down.  It’s merely a tool to aid an honest transaction.  Yup, you have the stamp of approval and you’re old enough and you’re in state.  We’re set.

Instead our elected representatives our creating a bureaucratic mess that we will have to maintain to prove our innocence.  They aren’t interested in improving safety or helping the law-abiding do the right thing.  No, all they want is another law they can use to hang a gun owner with when they feel like it. -B ]

 

Washington State, Good News and Bad News

So most people have heard by now that atrocious “Assault Weapons Ban” has been killed off.  Do not believe any of the lies the sponsors are feeding now that it’s been uncovered it would destroy the 4th amendment as well.  This is the same bill they introduced in 2009.  What does scare me though is the number of people who weren’t even aware of 5737 and actually asked me if I was kidding when I mentioned it.

So the good news is we stopped that piece of horrible legislation from moving forward.  The bad news is Bill 1588 is moving forward.  It was passed through the House Judiciary Committee with the support of a Republican.

Rep. Mike Hope – From Lake Stevens

If you live in his district, I highly suggest you make sure that he is not re-elected.  He has shown what he thinks of you and your right to keep and bear arms.  The only way a law such as this could be enforced is through universal registration, and never mind the additional burden to federal services.

A right delayed is a right denied and that’s exactly what they would do by forcing everything through NICS.  Make no mistake about this folks, there are simple things they could do to aid honest law-abiding people keep guns out of the hands of criminals as well as improving the load on the Federal system.  Instead they decide to attack the innocent and criminalize them.  Instead they do everything they can to prevent the law-abiding from being able to easily and effectively obtain arms.  Make no mistake about the problems behind background checks.

What happens when I loan a friend a side arm for a USPSA match because his broke?  What happens when another friend wants to use my AR for a coyote hunt and I’m not going to be there?  The whole system is nothing more than a sham to destroy the ability for gun owners to be able to freely associate and exchange firearms.  Tell me, if I know Bob and Bob has firearms, why can I not let him borrow one of my firearms?  Yes this type of BS background check legislation serves to criminalize exactly that type of incident.

Start ringing the rules committee, hopefully we can kill it there.

Washington Residents, Contact Your State Legislators

Had something come across my screen tonight, and it’s not good news for those of us in Washington.

Washington lawmakers are beginning to coalesce around a plan that would expand the state’s laws on gun background checks, providing hope for supporters after years of failed efforts.

While the measure is supported by many Democrats, the background checks plan also picked up support from Republican Rep. Mike Hope of Lake Stevens, Republican Sen. Steve Litzow of Mercer Island and Senate Majority Leader Rodney Tom, a Democrat who has aligned himself with Republicans this year. The Washington Association of Sheriffs and Police Chiefs also supports the idea.

This is not a joke folks and this is deadly serious.  The bill in question is SB 5711 and as you can see there are some Republican’s selling us and our rights up the river.  Make no mistake folks, this has nothing to do with background checks and never mind that in the end they wont actually do anything.

Our opponents claim that it will not deny anyone their rights, except many are delayed for no reason other than NICS cannot handle the load.  In December the local gun shop was having trouble getting through to NICS to complete purchases.  There are no provisions in this law to create a state system or otherwise provide additional funding to the federal system.  All it will do is increase burden, which will decrease availability and increase the difficulty and delay in getting  a firearm.  Further without a state registry there is no way this law could be effectively enforced.  Given the behavior of California and New York with moves for confiscation, does anyone think that’s a good idea?

Tell me, if the state is so desperate for background checks at the state level, why not just place an endorsement on every drivers license indicating that they are not a prohibited person.  Now the background check merely becomes checking your driver’s license.  Or why not do something like Idaho, your CPL satisfies the NICS requirement, lessen the burden on the federal system.

The problem is those creating this legislation aren’t actually interested in solutions to the problem they claim to be after.  Their problem statement is as follows:

How do we disarm the citizens of the State of Washington?

Their statement isn’t:

How can we work to aid the law-abiding people of Washington in preventing arms from falling into the hands of criminals while also protecting the rights of the law-abiding?

Think about that long and hard folks.  Don’t believe the lies they feed you.  Most certainly do not think that republicans are on your side.  Tonight’s post was originally going to be on an event that occurred last Saturday but that will be delayed until tomorrow.

There are more bills in the works than just this one as well.  Public hearings are scheduled for 0800 on Wednesday the 13th.

What I need, what your fellow gun owners of Washington need is for all of you sound the alarm and contact your representatives and attend the hearings if you can.  This fight is real and it’s down right serious.

It doesn’t cost the anti-gunners a damned thing to introduce bills. True, most of them will never see the light of day, but it’s the one you don’t expect that makes it through and makes your life a living hell. This is very much like how an inmate in a prison can harass the person who put them in there – they can file frivolous lawsuit after frivolous lawsuit against them. The inmate doesn’t pay a dime, but the target expends a lot of capital fighting them.

This is what is going on right now. They are trying to wear us out with so many horrific bills that what they really want will get passed when we’re too exhausted to fight any more.

[Back when the first pushes were happening in Illinois I figured this was their game plan.  Distract, divide, and exhaust us by creating numerous issues at the state level we cannot as effectively fight at the national level.

We keep seeing little BS bills come up here and there and they all require our attention lest we lets one slip by and get burned.

I’ve got a post I need to write-up tonight.  I just had some WA specific legislation roll into my inbox this morning.  Do I think it will pass? No, but if we do nothing it most certainly will pass.

Yes it sucks and yes it can be exhausting, at the same time though we can start introducing our own bills to push forward.  If we’re going to be stuck writing in about bad legislation, we might as well be able to say at the same time, please support this bill over here.  Our enemies are fewer and not as capable at defeating legislation we push forward.  Lets work this momentum to our advantage. -B]
